CONDITIONS FOR ACCOMMODATION CONTRACT

Article 1 – Scope of application

  • ・Accommodation agreements and related agreements concluded between this Facility and the guest shall be in accordance with the provisions set forth in these Terms and Conditions. Matters for which no provisions have been set forth in these Terms and Conditions shall be settled in accordance with law or generally recognized business customs.
  • ・Notwithstanding the provisions of the preceding Paragraph, when this Facility has agreed to a supplementary agreement that falls within the scope of application laws or business customs, the provisions of said supplementary agreement shall prevail.

Article 2 – Application for accommodation agreement

  • ・Guests attempting to applying for an accommodation agreement with this Facility must provide the Facility with the following information.
    • (1) Guest name, occupation, telephone number, gender, age, nationality, and address;
    • (2) Number of days of stay and planned arrival time;
    • (3)Accommodation fees (as outlined under Accommodation Fees in Appended Table 1); Other information deemed required by the Facility.
    • (4)Other information deemed required by the Facility.

•If, during their stay, the guest requests an extension of their stay beyond the number of days indicated in Article 1, Subparagraph 2, at the point said request is received the Facility shall process the request as a new application for an accommodation agreement.

Article 3 – Execution of accommodation agreement

  • ・An accommodation agreement shall be deemed executed at the point the application prescribed in the preceding Article is approved by the Facility.
  • ・When an accommodation agreement is executed in accordance with the provisions of the preceding Paragraph, the guest shall pay an application fee equivalent to the base accommodation fee for the request period of stay.
  • ・The application fee shall first be applied towards the final accommodation fee to be paid by the guest. In the event of circumstances set forth in Article 5 or Article 17, the application fee shall be applied towards applicable cancellation fees and compensation amounts, in that order. In the event of any remaining amounts, the remainder shall be refunded at the time of the payment of amounts set forth in the provisions of Article 11.
  • ・When the application fee prescribed in Paragraph 2 is not paid by the date stipulated by the Facility in accordance with the provisions of said Paragraph, the accommodation agreement shall be deemed invalid and unenforceable.

Article 4 – Rejection of accommodation agreement execution

  • ・The Facility may decline to execute an accommodation agreement in the event of the following:
    • (1)When the accommodation application does not comply with these Terms and Conditions;
    • (2)When there are no vacant rooms due to full occupancy;
    • (3)When the person attempting to stay conducts acts, or is deemed likely to conduct acts, that are in violation of legal provisions, public order, or public decency;
    • (4)When the person attempting to stay is deemed applicable to any of the following a) through c).
      • a)A violent organization as defined under Article 2, Subparagraph (2) of the Act on Prevention of Unjust Acts by Organized Crime Group Members (1991 Act No. 77) (hereinafter, Organized Crime Group), an organized crime group member as defined under Article 2, Subparagraph (6) of said law (hereinafter, Organized Crime Group Member), an associate member of an Organized Crime Group, an Organized Crime Group affiliate, or any other antisocial force.b) A corporation or other organization whose business activities are controlled by an Organized Crime Group or an Organized Crime Group Member. c) A corporation whose officer is an Organized Crime Group Member or the equivalent.
      • b)A corporation or other organization whose business activities are controlled by an Organized Crime Group or an Organized Crime Group Member.
      • c)A corporation whose officer is an Organized Crime Group Member or the equivalent.
    • (5)When the person attempting to stay is engaged in behavior that significantly inconveniences other guests;
    • (6)When the person attempting to stay is deemed to clearly be infected with an infectious disease;
    • (7)When the person attempting to stay makes forceful or unreasonable requests concerning their stay;
    • (8)In cases of natural disasters, facility malfunctions, or other unavoidable circumstances that prevent the Facility from providing accommodations;
    • (9)Persons who are intoxicated or otherwise when there is concern the guest will significantly inconvenience other guests or neighborhood residents;
    • (10)Persons engaging in abnormal behavior or actions;
    • (11)Persons clearly lacking the ability to make payment;
    • (12)Persons who violate the provisions of Article 2, Subparagraph (1);
    • (13)Persons for whom it is otherwise deemed justifiable to deny accommodations.

Article 5 – Guest’s right to cancel agreement

  • ・Guests may submit a request to the Facility to cancel an accommodation agreement.
  • ・When the guest cancels the accommodation agreement in whole or in part for reasons attributable to the guest (excluding cases when the Facility stipulates an application fee payment deadline and requests payment in accordance with the provisions of Article 3, Paragraph 2 and the guest cancels the accommodation agreement prior to making said payment), the Facility may request a cancellation fee in accordance with provisions set forth in Appended Table 2. Furthermore, if the accommodation reservation was made through an internet-based reservation website, etc., the cancellation policy of said reservation website shall take precedence.
  • ・If the guest fails to contact the Facility and does not arrive by 7:00pm on the date of accommodation (if a planned arrival time has been stipulated in advance, then one hour after said time), the accommodation agreement may be treated as having been cancelled by the guest.

Article 6 – Facility’s right to cancel agreement

The Facility may terminate an accommodation agreement in the event of the following:

  • (1) When the guest conducts acts, or is deemed likely to conduct acts, that are in violation of legal provisions, public order, or public decency, or is deemed to have conducted such acts;
  • (2) When the guest is deemed applicable to any of the following a) through c).
    • a) An Organized Crime Group, an Organized Crime Group Member, an Organized Crime Group associate or affiliate, or any other Antisocial Forces.
    • b) A corporation or other organization whose business activities are controlled by an Organized Crime Group or an Organized Crime Group Member.
    • c) A corporation whose officer is an Organized Crime Group Member or the equivalent.
  • (3) When the guest engages in behavior that significantly inconveniences other guests or surrounding residents;
  • (4) When the guest is deemed to clearly be infected with an infectious disease;
  • (5) When the guest makes unreasonable requests concerning their stay;
  • (6) Cases of natural disasters or other force majeure resulting in unavoidable circumstances that prevent the Facility from providing accommodations;
  • (7) When the guest is intoxicated or will otherwise significantly inconvenience other guests;
  • (8) Persons that engage in loud singing, bustling acts, singing and dancing, and other acts that inconvenience other guests.
  • (9) Persons clearly lacking the ability to make payment;
  • (10) Persons engaging in abnormal behavior or actions;
  • (11) Persons who disturb fire prevention facilities;
  • (12) Persons applicable to provisions prescribed in Article 5 of the Kyoto Accommodation Industry Act Enforcement Ordinance;
  • (13) When a guest makes threatening requests against the Facility or its employee, or makes unreasonable requests;
  • (14) In the event the guest fails to comply with these usage regulations or when the Facility terminates an accommodation agreement in accordance with the provisions of the above Subparagraph (4) or Subparagraph (6), the Facility shall not request payment for any accommodation services the guest has yet to receive.

Article 7 – Accommodation registration

On the day of accommodation, guests are required to provide the following information at check-in.

  • (1) Guest name, age, gender, address, and occupation;
  • (2) Foreign guests are asked to provide their nationality, passport number, and location and date of entry into Japan;
  • (3) Departure date and planned departure time;
  • (4) Other information deemed required by the Facility.

Article 8 – Guest room usage time

  • ・The times during which the guest may use the Facility room shall be from 3:00pm to 11:00am the following day. However, when the guest will stay for consecutive days, the guest may use the room all day (excluding on check-in and check-out days).
  • ・Notwithstanding the provisions of the preceding Paragraph, the Facility may approve room use outside the times stipulated in said Paragraph. In such cases, the following additional fees shall be assessed:
    • (1) Up to 3 hours beyond checkout: 30% the room rate,
    • (2) Up to 6 hours beyond checkout: 50% the room rate,
    • (3) More than 6 hours beyond checkout: 100% the room rate.

Article 9 – Compliance with Usage Regulations

While in the Facility, the guest shall comply with the Facility’s prescribed Usage Regulations posted inside the Facility.

Article 10 – Operating hours

  • ・Facility operating hours are as indicated in provided pamphlets, facility placards and signs, and in service directories provided in guestrooms.
  • ・Details concerning check-in time, check-out time, and curfew are as follows:
    • 1.Check-in: From 3:00pm,
    • 2.Check-out: By 11:00am,
    • 3.Curfew: No curfew for whole-house rental.

Article 11 – Payment of fees

  • ・A breakdown of accommodation fees to be paid by the guest is as indicated in Appended Table 1.
  • ・In principle, the payment of the aforementioned accommodation fees, etc. must be paid in advance via credit cards accepted by the Facility (in some exceptions, a bank transfer), WeChat Pay, or Airpay. For reservations made via internet reservation websites, the payment rules of said reservation website shall take precedence.
  • ・After the Facility provides the guest a room and the room has become available, accommodation fees will be charged even if the guest does not use the room at his or her own discretion.

Article 12 – Facility responsibilities

  • ・If during the execution of or due to a failure to fulfill the accommodation agreement or related agreements, the Facility causes damage to the guest due to the failure to fulfill said agreements, the Facility shall compensate the guest for said damages. However, this shall not be applicable when said non-fulfillment is not due to reasons attributable to the Facility.
  • ・The Facility is enrolled in fire insurance and accommodation facility liability insurance to address the unlikely event of a fire or facility accident.

Article 13 – Handling when a contracted room cannot be provided

  • ・In the event the Facility is unable to provide a contracted room to a guest, to the extent possible the Facility shall, pursuant to approval from the guest, work to procure accommodations at another accommodation facility based on the same conditions.
  • ・Notwithstanding the provisions of the preceding Paragraph, when the Facility cannot arrange accommodations at another accommodation facility, the Facility shall pay compensation to the guest in the form of an amount equivalent to the cancellation fee. This compensation fee shall be applied towards any damages owed to the guest. However, no compensation shall be paid when the inability to provide a guestroom is due to reasons not attributable to the Facility.

Article 14 – Handling of stored valuables

The Facility does not provide storage for valuables. The Facility shall bear no liability whatsoever in the event of any loss of or damage to any belongings, cash, or valuables brought into the Facility.

Article 15 – Storage of guest luggage and personal belongings

  • ・If the guest has forgotten luggage or personal belongings (including items stored inside the safe) after checking out, the Facility shall store the items for seven (7) days (including the day of discovery), after which the Facility will notify the nearest police station. All other items shall be disposed of. However, if a forgotten item is deemed not conducive to hygiene, the Facility shall dispose of the object on the day of discovery during cleaning.
  • ・Excluding cases of deliberate acts or gross negligence, the Facility shall bear no liability whatsoever in the event of the loss of or damage to luggage the Facility has agreed to store after check-out.

Article 16 – Parking lot

The Facility does not have a dedicated parking lot. Guests are asked to use nearby coin parking.

Article 17 – Guest liability

If the guest, as the result of intent or negligence, causes damages to the Facility, the guest shall pay compensation for said damages.

Article 18 – Facility indemnity

  • ・The Facility shall bear no liability for noise or vibrations from neighboring properties.
  • ・Due to characteristics unique to older properties, the property has low ceilings and a steep stairwell. Please note that the Facility shall bear no liability whatsoever for injuries that occur on the premises. The guest bears full liability for their stay at the Facility.
  • ・The Facility provides meals as an option to guests who make a request. Meal provision is based on a service agreement with a third-party vendor and the Facility bears no liability whatsoever related to meals.
  • ・All handling concerning the accommodation agreement shall be in accordance with applicable laws in Japan.
  • ・For any disputes occurring in relation to accommodation agreements executed in accordance with these Terms and Conditions, either the summary court or the district court, depending on the amount of the lawsuit, with jurisdiction over the location of the Facility shall be agreed exclusive jurisdictional court of first instance. The original language of these Terms and Conditions is Japanese and the English version is a translation. The English version is merely created as a reference document for the original Japanese, and the Japanese language document shall take precedence over any other versions.
  • ・The Facility may revise or change these Terms and Conditions to reflect changes in socioeconomic or general market conditions without any prior notice to guests.

  • ・Penalty will be calculated from the day when the guest notifies the cancellation of the contract.
  • ・The cancellation fee is the ratio of the penalty to the basic accommodation fee.
  • ・If the contract days are shortened, a penalty equivalent to the shortened days will be charged.
