CONDITIONS FOR ACCOMMODATION CONTRACT

Article 1 – Scope of Application

  • ・Accommodation contracts and related agreements concluded between this Guesthouse and guests shall be governed by these Terms and Conditions. Matters not stipulated here in shall be governed by applicable laws and regulations or generally accepted practices.
  • ・In cases where this facility has entered into a special agreement with the guest within the scope not violating laws, regulations, or general customs, such special agreement shall prevail notwithstanding the preceding paragraph.

Article 2 – Application for Accommodation Contract

  • ・Guests applying for an accommodation contract shall provide the following information to this guesthouse:
    • (1) Name, date of birth, address, nationality, phone number, and email address of the guest.
    • (2) Accommodation dates and estimated arrival time.
    • (3)Accommodation charges (in principle based on the basic accommodation fees listed in Appendix1).
    • (4)Any other information deemed necessary by the guesthouse.

•If a guest requests to continue staying beyond the accommodation period. specified in Paragraph 2 during their stay, the guesthouse shall treat such request as a new application for an accommodation contract.

Article 3 – Formation of Accommodation Contract

  • ・The accommodation contract shall be deemed concluded when the Guesthouse accepts the application described in the preceding article.
  • ・Upon conclusion of the accommodation contract pursuant to the preceding paragraph, the guest shall pay a deposit equivalent to the basic room charge for the accommodation period by the date designated by the Guesthouse. (In principle, payment shall be made by credit card at the time the accommodation contract is concluded; exceptionally, with the guesthouse’s consent, payment may also be made by bank transfer before the designated date, and the guest shall bear any bank transfer fees.).
  • ・The deposit shall first be applied to the final accommodation charges. payable by the guest. If situations stipulated under Articles 6 and 18 arise, the deposit shall be applied first to cancellation charges and then to compensation for damages. Any remaining balance shall be refunded at the time of payment pursuant to Article 12.
  • ・The deposit shall first be applied toward the final accommodation charges. payable by the guest; if circumstances under Article 5 or Article 17 apply, it shall then be applied toward penalties and compensation respectively; any remaining balance shall be refunded upon settlement of charges pursuant to Article 11.
  • ・If the guest fails to pay the deposit described in Paragraph 2 by the designated date (in principle by credit card upon conclusion of the guesthouse’s consent, with transfer fees borne by the guest), the accommodation contract shall become invalid.

Article 4 – Refusal to Conclude Accommodation Contract

  • ・he Guesthouse reserves the right to refuse the conclusion of an accommodation contract in any of the following cases:
    • (1)The application does not comply with these Terms and Conditions;
    • (2)No rooms are available due to full occupancy;
    • (3)The prospective guest is deemed likely to engage in conduct violating. laws, public order, or good morals;
    • (4)The prospective guest is deemed to fall under any of the following categories:
      • a)Organized crime groups (“Boryokudan”), members thereof, associatemembers, related persons, or other anti-social forces as defined under the Act onPrevention of Unjust Acts by Organized Crime Group Members (Act No. 77 of 1991).
      • b)Corporations or organizations whose business activities are controlled by organized crime groups or members thereof.
      • c)Corporations whose directors or management personnel include organized crime group members.
    • (5)The prospective guest has engaged in behavior causing serious. inconvenience to other guests;
    • (6)The prospective guest is clearly recognized as carrying an infectious disease;
    • (7)Violent demands or unreasonable requests are made regarding accommodation;
    • (8)Accommodation cannot be provided due to natural disasters, facility. breakdowns, or other force majeure events;
    • (9)Guests who are intoxicated or otherwise likely to disturb other guests or neighboring residents;
    • (10)Persons exhibiting suspicious or abnormal behavior;
    • (11)Persons who clearly lack the ability to pay;
    • (12)Persons who violate Article 2, Paragraph 1;
    • (13)Any other case where the guesthouse deems refusal justified.

Article 5 – Guest’s Right to Cancel the Contract

  • ・Guests may request cancellation of the accommodation contract.
  • ・If the guest cancels all or part of the accommodation contract for reasons attributable to the guest, the guesthouse shall charge cancellation fees in accordance with Appendix2.(However, this shall not apply where the guesthouse requested advance payment pursuant to Article 3, Paragraph 2 and the guest canceled before making such payment.)
  • ・In the case of reservations made through internet booking platforms or similar services, the cancellation policy stipulated by the relevant booking platform shall apply.
  • ・If the guest has not arrived by 7:00 PM on the accommodation date and has not contacted the guesthouse (or more than one hour after the notified estimated arrival time), the guesthouse may treat the reservation as canceled by the guest.

Article 6 – Guesthouse’s Right to Cancel the Contract

The guesthouse may cancel the accommodation contract in any of the following cases:

  • (1) The guest is deemed likely to engage in conduct violating laws, public order, or good morals, or has already engaged in such conduct;
  • (2) The guest is deemed to fall under any of the following categories:
    • a) Organized crime groups, members thereof, associate members, related persons, or other anti-social forces.
    • b) Corporations or organizations controlled by organized crime groups or members thereof.
    • c) Corporations whose directors or management personnel include organized crime group members
  • (3) The guest engages in conduct causing serious inconvenience to other guests or neighboring residents;
  • (4) The guest is clearly recognized as carrying an infectious disease;
  • (5) The guest makes demands regarding accommodation that exceed a reasonable scope;
  • (6) Accommodation cannot be provided due to force majeure such as natural disasters;
  • (7) Guests who are intoxicated or otherwise likely to disturb other guests;
  • (8) Guests who engage in loud singing, shouting, dancing, playing music, or similar conduct disturbing other guests during their stay.
  • (9) Guests who are clearly deemed unable to pay;
  • (10) Guests deemed suspicious in behavior;
  • (11) Guests who intentionally damage fire prevention facilities;
  • (12) Cases falling under Article 5 of the Kyoto Prefecture Ryokan Business Act Enforcement Ordinance;
  • (13) Guests who commit acts of violence against the Guesthouse or its make unreasonable demands;
  • (14) Guests who otherwise fail to comply with the rules of use established by the guesthouse
  • If the Guesthouse cancels the accommodation contract pursuant to Item (4) or (6) above, the guesthouse shall not charge the guest for accommodation services not yet provided.
  • Article 7 – Accommodation Registration

    Guests shall complete the following registration procedures on the day of accommodation:

    • (1) Name, date of birth, address, telephone number, and email address;
    • (2) Foreign guests shall additionally register nationality, passport number, port of entry, and date of entry into Japan;
    • (3) Departure date and estimated departure time;
    • (4) Any other matters deemed necessary by the guesthouse.

    Article 8 – Hours of Room Use

    • ・Guests may use their rooms from 3:00 PM on the check-in date until 11:00. AM on the check-out date. For consecutive stays, rooms may be used throughout the day except on the check-in and check-out dates.
    • ・If a guest continues to use the room beyond the check-out time, the. guesthouse shall charge additional fees according to the overtime period:
      • (1) Up to 3 hours: JPY 22,000
      • (2) Up to 6 hours: JPY 44,000
      • (3) More than 6 hours: 100% of the accommodation fee

    Article 9 – Compliance with Rules of Use

    Guests shall comply with the rules of use established and posted by the guesthouse while staying at the facility.

    Article 10 – Hours

    • ・Information regarding business hours and related matters shall be provided in brochures available within the guesthouse, notices posted throughout the facility, and service guides in guest rooms.
    • ・Regarding check-in, check-out, and curfew:
      • 1.Check-in: Check-in: From 3:00 PM on the accommodation date
      • 2.Check-out: By 11:00 AM,
      • 3.Curfew: As this facility is rented as an entire building, there is no curfew

    Article 11 – Payment of Charges

    • ・Details of accommodation charges payable by guests are listed in Appendix 1
    • ・In principle, accommodation charges shall be paid in advance by credit card. approved by the guesthouse (or exceptionally by bank transfer). For reservations made through internet booking platforms, the payment policies of the relevant booking platform shall prevail.
    • ・Once a guest room has been made available and is ready for use, accommodation charges shall still apply even if the guest does not actually stay.

    Article 12 – Liability of the Guesthouse

    • ・If the Guesthouse causes damage to the guest through performance or non-performance of the accommodation contract or related agreements, the guesthouse shall compensate for such damage, except where such damage is not attributable to reasons for which the Guesthouse is responsible..
    • ・The facility is covered by guesthouse liability insurance in preparation for emergencies such as fire.

    Article 13 – Handling When Reserved Room Cannot Be Provided

    • ・If the Guesthouse is unable to provide the reserved room, it shall, with the guest’s consent, make every effort to arrange equivalent accommodation elsewhere.
    • ・If the Guesthouse cannot arrange alternative accommodation as described above, it shall pay compensation equivalent to the cancellation charge amount (see Appendix 2) as damages. However, no compensation shall be paid where the inability to provide accommodation is not attributable to the Guesthouse.

    Article 14 – Handling of Deposited Items

    The Guesthouse does not provide storage services for belongings. The Guesthouse shall not be liable for loss or damage of items, cash, or valuables brought into the facility by guests.

    Article 15 – Custody of Guest Luggage and Personal Belongings

    • ・If luggage or personal belongings are left behind after check-out, the Guesthouse shall keep them until the end of the month following the month of discovery, after which they will be handed over to the nearest police station. Other items may be disposed of at the Guesthouse discretion.
    • ・However, for hygiene reasons, the guesthouse may dispose of such items during cleaning on the day they are found.
    • ・After check-out, the Guesthouse shall only be responsible for items it has expressly agreed to keep. Except in cases of intentional misconduct or gross negligence by the guesthouse, the guesthouse shall not be liable for loss or damage of stored items.

    Article 16 – Parking

    The guesthouse does not provide guest parking facilities. Guests are requested to use nearby paid parking lots.

    Article 17 – Liability of Guests

    Guests shall compensate the Guesthouse for damages caused intentionally or negligently by the guest.

    Article 18 – Disclaimer

    • ・The Guesthouse shall not be liable for noise or vibration arising from the surrounding environment.
    • ・Due to the characteristics of traditional machiya houses, ceilings may be low and staircases steep. The guesthouse shall not be liable for injuries sustained within the facility, and guests stay at their own risk.
    • ・The guesthouse may arrange food and beverage services upon request; however, contracts for such services are concluded directly between the service provider and the guest, and the guesthouse assumes no responsibility.
    • ・Matters relating to accommodation contracts shall be governed by the laws of Japan.
    • ・Any disputes arising from accommodation contracts under these Terms shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Guesthouse as the court of first instance, with either the summary court or district court having jurisdiction depending on the amount in dispute. The Japanese version of these Terms shall be the official text, while the Chinese and English versions are provided for reference only. In the event of discrepancies, the Japanese version shall prevail.
    • ・The Guesthouse reserves the right to revise or amend these Terms without prior notice to guests due to changes in social or economic conditions or other relevant circumstances.

    (note)

    • ・Cancellation charges shall be calculated based on the date on which the guest notifies the property of the cancellation.
    • ・Cancellation charges are assessed as a percentage of the basic accommodation fee.
    • ・In the event that the number of reserved nights is reduced, a cancellation charge equivalent to the accommodation fee for the cancelled nights will be applied.
